This privacy policy (“Privacy Policy”) describes how ACollaboratory America Inc.  and its subsidiaries and affiliates (“ACollaboratory”, “we”, “us” or “our”) collect, use, store, and share your information when (1) you access and/or use our websites, mobile applications, or other digital properties we own and operate, including https://www.tsklab.com and https://shopusa.tsklab.com (“Websites”); (2) you use our services to purchase products (“Services”); (3) you communicate with us in any manner, including by email, direct messaging, telephone, and/or in person (“Communications”); and (4) we interact with certain third party partners.

2.   What Type Of Information Do We Collect?

Depending on how you interact with our Websites and Services, the nature of our Communications, and how we may interact with certain third party partners, we may collect the following pieces of your information:

 

  • Basic Identifying Information. Information you provide when you sign-up for an account for our Services such as your full name, postal address, e-mail address, phone number, account name, username, and other similar identifiers.
  • Device Identifier and other Unique Identifiers. Information such as your device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, and other unique identifiers.
  • Internet or Other Network Activity. Information such as your browsing or search history, and other information regarding your interactions with our Websites, emails, and advertisements.
  • Geolocation Data. Information including imprecise location data (such as location derived from an IP address or data that indicates a city or postal code level) and, with your consent, precise location data (such as latitude/longitude data).
  • Payment Information. Information related to your payment method, including your credit card number, card expiration date, security code, and billing address. Payment information may be processed by our payment processor, in which case such payment processor will be collecting and processing such information on our behalf and share with us limited details as necessary for us to verify, record and fulfil completed transactions.
  • Commercial Information. Information such as the products and samples you have purchased and considered, your preferences on various products and brands, photographs of your receipts containing purchases, and related information about your commercial activities. 
  • User Content. Information such as your Communications with us and any other content you provide, such as social media profiles, photographs of receipts, images, videos, survey responses, comments, product reviews, testimonials, and other content.
  • Employment Content. Information such as the employer you work for, your position, required licensure information, and your work contact information.
  • Audio and Visual Information. Information such as photographs, images, videos, and recordings of your voice (such as when we record customer service calls for quality assurance).
  • Inferences. Information such as inferences drawn from or created based on the information identified above.

You may choose to voluntarily provide other information to us that we do not request, and, in such instances, and in such situations we have no control over what categories of personal information such disclosure may include. Any additional information provided by you to us is provided at your own risk. 

3.   How Do We Collect Your Information?

We collect your information in three ways: (1) directly from you when you use our Websites, Services, and Communicate with us; (2) automatically using online technologies when you engage with our Websites, Services, and Communications; and (3) from our third party partners.

 

  • Directly from you. We collect information directly from you when you enter your information on our Websites, create an account for our Services, access our content, engage in any refunds, provide any feedback, use our Websites and Services, fulfill orders related to your purchases, engage in Communications with us, or sign-up to receive emails, text messages, or certain other Communications from us.
  • Automatically Using Online Technologies. 4.   Automatic Information Collection Technologies

A.         Technologies Used

•           Cookies. Cookies are small bits of data cached or stored on your computer based on Internet activity. Information collected through cookies may be obtained directly by or shared with third parties so that those third parties can provide analytics and advertising services to us. We use first party and third party cookies and other tools to monitor individual activity in aggregate to improve the Websites. The information we gather includes IP address, user language, the operating system, browser type, the presence/absence of “flash” plug-ins, screen resolution, connection type, browsing behavior, and information that identifies the cookie.

•           Pixels: Pixels (also known as web beacons) are types of code embedded in a website, video, email, or advertisement that sends information about your use to a server. When you access a website, video, email, or advertisement that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser.

•           Software Development Kits (SDKs): Software Development Kits (also known as “SDKs”) are sets of tools and code provided by third parties that are embedded in our mobile applications to enable specific functionalities and improve user experience. Some SDKs may collect data directly from your device, such as your IP address, device type, or usage patterns, to support these functions.

•           Analytic Tools: Analytic tools include technologies or software services that collect, measure, and analyze data about how users interact with our Websites and Services. These tools often use cookies, pixels, and similar technologies to gather information such as page views, clicks, and user behavior, which is then used to improve site functionality and user experience.

B.         Purpose For Using Automatic Information Collection Technologies

•           Functionality, Support and Security: Some of the online tracking technologies like the cookies we use for a variety of functionality and support purposes, such as to recognize your device, enable you to use checkout features, facilitate navigation, display information more effectively, personalize your experience such as recognize you when you leave or return to our Websites, maintain the security of our Websites, manage your account, prevent crashes, fix bugs, save your preferences, and assist with basic Websites functions and other performance functions. We also use the following specific third-party tools:

◦           ReCAPTCHA: We utilize Google reCAPTCHA on certain parts of our Websites to help protect against spam, abuse, and fraudulent activity. reCAPTCHA analyzes interactions with the Websites to determine whether an action is being performed by a human or an automated process. This service may collect information such as your IP address, browser details, and user behavior data, which is transmitted to and processed by Google in accordance with Google's Policies and Terms of Service. The use of reCAPTCHA is essential for maintaining the security and integrity of our Websites and your information.

•           Website and Behavioral Analytics: We also use pixels in combination with cookies to track activity by a particular browser on a particular device. These pixels are provided by a third party and certain information may be shared back with such provider. In addition, we may use technologies included in applications (that are not browser-based like cookies and cannot be controlled by browser settings), such as SDKs, to track our communications, bring you advertising, and provide you with additional functionality, such as the ability to connect your account on our Websiteswith other third-party services. ◦           Shopify Platform: Our Websites utilizes the Shopify platform, which provides us with the tools to sell products and services, track visitor behavior, and analyze site traffic. As part of using Shopify’s services, we may collect certain data through the Shopify analytics tools, including but not limited to, information about your interactions with our site, browsing patterns, and any purchases made.

5.   How Do We Use Your Information?

We use your information for a variety of purposes, including to:

B.    Communications

The following is information about how to opt out of receiving certain communications from us, depending on means of delivery:

  • E-mails. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or our ongoing business relations.
  • Phone & SMS Text Messaging. You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” in response to any text message you receive from us or contacting us as set out in the Contact Us section below and specifying you want to opt-out of text messages; and (ii) for calls, requesting opt-out during any call you receive from us or contacting us as set out in the Contact Us section below and specifying you want to opt-out of calls.
